1.1. Acceptance of Terms
By accessing, installing, or using Archipelago (“the Plugin”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Plugin.
Archipelago is owned and operated by João Martino – Nonverbal Design, Lda, a company registered in Portugal.
1.2. Description of Service
Archipelago is a Figma plugin that streamlines multi-format design workflows by enabling intelligent content synchronization and variant management across different aspect ratios and formats.
1.3. License Types & Grant
1.3.1 Beta License (v2.x)
- Free, non-exclusive, non-transferable license
- Valid during beta period only
- Transitions to v2.0 terms upon launch
1.3.2 Individual License (v3.0+)
- Price: archipelago-individual ($29)
- Grant: Perpetual, non-exclusive, non-transferable right to use Archipelago
- Scope: Single user, unlimited devices and projects
- Updates: All v3.x updates included (3.0, 3.1, 3.2, etc.)
- Limitations: Does not include major version upgrades (v4.0+)
1.3.3 enterprise License (v3.0+)
- archipelago-enterprise ($299)
- Grant: Perpetual, non-exclusive, non-transferable right to use Archipelago
- Scope: Unlimited users within single organization
- Updates: All v3.x updates included
- Benefits: Priority support, shared template library
- Limitations: Does not include major version upgrades (v4.0+)
1.3.4 Beta Contributor License
- Price: Free (earned through feedback during beta)
- Grant: Equivalent to Individual License
- Scope: All Individual License benefits
- Additional: 50% discount on v4.0 upgrade when available
1.4. Acceptable Use
You May:
- Use the Plugin for personal or commercial projects
- Create unlimited designs and variants
- Use on multiple devices (Individual) or unlimited users (Studio)
- Export and use generated designs without restriction
You May Not:
- Reverse engineer, decompile, or disassemble the Plugin
- Redistribute, resell, or sublicense the Plugin
- Remove or modify proprietary notices or branding
- Share license keys with unauthorized users
- Use the Plugin to create competing products
- Violate any applicable laws or regulations
1.5. Intellectual Property
Our Rights
All rights, title, and interest in Archipelago, including all intellectual property rights, algorithms, and code, remain the exclusive property of João Martino – Nonverbal Design, Lda.
Your Rights
You retain all rights, title, and interest in designs, content, and files created using Archipelago. We claim no ownership of your creative work.

1.7. Data & Privacy
What We Store
- Locally: Plugin preferences, island configurations, focal point data (stored in Figma files)
- Server: License validation data (email, purchase ID)
- Optional: Anonymous usage analytics, crash reports
What We Don’t Store
- Your design content or files
- Personal information beyond email for licensing
- Tracking data across websites or applications
1.8. Warranties & Disclaimers
Limited Warranty
We warrant that the Plugin will substantially perform as described in documentation for 30 days from purchase. Your sole remedy for breach is refund under our Refund Policy.

EXCEPT AS EXPRESSLY PROVIDED ABOVE, ARCHIPELAGO IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Beta Software
Beta versions (v2.x) are provided AS-IS with no warranties. Use at your own risk.
1.9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Developer Not Liable For:
- Data loss, corruption, or design errors
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or business opportunities
- Damages arising from use or inability to use the Plugin
- Third-party claims
Maximum Liability
João Martino – Nonverbal Design, Lda’s total liability shall not exceed the amount paid for the license (or $0 for beta/free licenses).
1.10. Support
Included Support
- Individual: Email support (info@archipelago-figma.me), best effort response
- Studio: Priority email support, 48-hour response target
- Beta: Best effort, no SLA
Not Included
- Custom development or feature requests
- Training or consulting services
- Support for third-party tools or integrations
1.11. Updates & Upgrades
Included Updates
Your license includes all updates within the major version (e.g., 3.0 → 3.9).
Major Version Upgrades
Upgrades to new major versions (v4.0+) require new purchase or paid upgrade. v3 license holders receive:
- Exclusive early access period
- Discounted upgrade pricing (50% off)
- Continued use of v3.x indefinitely
1.12. Termination
By You
Uninstall the Plugin at any time. License remains valid for future reinstallation.
By Us
We may terminate your license if you:
- Violate these Terms of Service
- Share license keys improperly
- Engage in fraudulent activity
- Use Plugin for illegal purposes
Effect of Termination
Upon termination, you must cease using the Plugin. No refund for violations.
1.13. Changes to Terms
We may update these terms at any time. Material changes will be communicated via:
- Email to license holders
- In-plugin notifications
- Website announcements
Continued use after changes constitutes acceptance. Changes don’t affect existing licenses except as required by law.
1.14. Governing Law
These terms are governed by the laws of Portugal and, where applicable, European Union regulations, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Portugal.
1.15. General Provisions
Entire Agreement
These terms constitute the entire agreement regarding Archipelago.
Severability
Invalid provisions don’t affect remaining terms.
No Waiver
Failure to enforce doesn’t waive rights.
Assignment
You may not assign your license. We may assign without notice.
Independent Contractor
No partnership, agency, or employment relationship created.

Important: All design data stored locally in your Figma files. We never see or store your design content.

- Improve plugin functionality and performance
- Detect and prevent fraud or abuse
- Comply with legal obligations
We Do Not:
- Sell or rent your personal information

How Long We Keep Data
- License data: Duration of license validity + 7 years (tax/legal requirements)
- Support emails: 3 years after last contact
- Usage analytics: Aggregated data retained indefinitely, individual data 2 years
- Crash reports: 90 days
Your Design Data
Stored only in your Figma files. Deleted when you delete your Figma files. We have no access or retention.
2.8. International Data Transfers
As a company based in Portugal (European Union), we process data primarily within the EU. Data processing complies with GDPR standards.
If data is transferred outside the EU, we ensure adequate protections through:
- Standard Contractual Clauses
- Service provider agreements with GDPR compliance
2.9. Children’s Privacy
Archipelago is not intended for users under 16. We do not knowingly collect data from children. If you believe we have child data, contact us immediately at info@archipelago-figma.me.
2.10. Changes to Privacy Policy
We may update this policy. Material changes communicated via:
